Supreme Court asks Centre to curb misuse of personal data by private entities
The Supreme Court expressed concern over a commercial ecosystem allegedly accessing sensitive provident fund and income tax data, and urged the central government to devise safeguards with expert help.
The Supreme Court on Monday voiced concern about a commercial technological ecosystem that allegedly accesses, retrieves and verifies sensitive individual information from provident fund and income tax returns. A bench of Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana was hearing a public interest litigation filed by Piyush Sharma. The court noted that the matter largely fell within the policy domain, but described private access to sovereign data—information given to the government under legislative mandate—and its commercial exploitation as worrisome. It told the Centre about the desirability of formulating a remedy with the assistance of domain experts. The petitioner said his personal inquiry had revealed that merely furnishing PAN and UAN details to a private verification workflow could expose the data.
